Aliya 7

1 וַֽיִּקְרְב֞וּ רָאשֵׁ֣י הָֽאָב֗וֹת לְמִשְׁפַּ֤חַת בְּנֵֽי־גִלְעָד֙ בֶּן־מָכִ֣יר בֶּן־מְנַשֶּׁ֔ה מִֽמִּשְׁפְּחֹ֖ת בְּנֵ֣י יוֹסֵ֑ף וַֽיְדַבְּר֞וּ לִפְנֵ֤י מֹשֶׁה֙ וְלִפְנֵ֣י הַנְּשִׂאִ֔ים רָאשֵׁ֥י אָב֖וֹת לִבְנֵ֥י יִשְׂרָאֵֽל׃ Les chefs de famille de la descendance de Ghilad, fils de Makhir, fils de Manassé, de la lignée des enfants de Joseph, se présentèrent et parlèrent ainsi devant Moïse et devant les phylarques, principaux chefs des enfants d’Israël;
2 וַיֹּאמְר֗וּ אֶת־אֲדֹנִי֙ צִוָּ֣ה יְהֹוָ֔ה לָתֵ֨ת אֶת־הָאָ֧רֶץ בְּנַחֲלָ֛ה בְּגוֹרָ֖ל לִבְנֵ֣י יִשְׂרָאֵ֑ל וַֽאדֹנִי֙ צֻוָּ֣ה בַֽיהֹוָ֔ה לָתֵ֗ת אֶֽת־נַחֲלַ֛ת צְלׇפְחָ֥ד אָחִ֖ינוּ לִבְנֹתָֽיו׃ ils dirent: "L’Éternel a ordonné à mon seigneur d’attribuer le pays en héritage, par la voie du sort, aux enfants d’Israël; d’autre part, mon seigneur a été chargé par l’Éternel d’attribuer l’héritage de Celofhad, notre frère, à ses filles.
3 וְ֠הָי֠וּ לְאֶחָ֞ד מִבְּנֵ֨י שִׁבְטֵ֥י בְנֵֽי־יִשְׂרָאֵל֮ לְנָשִׁים֒ וְנִגְרְעָ֤ה נַחֲלָתָן֙ מִנַּחֲלַ֣ת אֲבֹתֵ֔ינוּ וְנוֹסַ֕ף עַ֚ל נַחֲלַ֣ת הַמַּטֶּ֔ה אֲשֶׁ֥ר תִּהְיֶ֖ינָה לָהֶ֑ם וּמִגֹּרַ֥ל נַחֲלָתֵ֖נוּ יִגָּרֵֽעַ׃ Or, si elles contractent mariage dans quelqu’une des autres tribus des enfants d’Israël, leur héritage sera retranché de l’héritage de nos pères, s’ajoutera à l’héritage de la tribu où elles auront passé, et notre lot patrimonial en sera amoindri.

And [even] when the Jubilee obtains for the children of Israel, [when sold land (as opposed to an inheritance) reverts to its original owner — Even when the Jubilee obtains (the implication being that it is destined to cease for a time)], their inheritance shall be added onto the inheritance of the tribe to which they are wed, and from the inheritance of the tribe of our fathers their inheritance will be diminished!

Rashi

English

And if the yoveil occurs. From here R’ Yehudah said that yoveil is destined to discontinue.

And if the yoveil occurs. As if to say, this is not a sale, which reverts on yoveil, for an inheritance does not revert on yoveil. So even if yoveil occurs, the inheritance will not revert to its tribe, and will thus be added to the inheritance of the tribe into which they marry.

And even when the Yoveil occurs. And even if there will be a Yoveil, we will not hope to return the inheritance to us, it will always just be an addition to the inheritance of the tribe.

יגרע נחלתן, even in the event that we will not now conquer the whole land, as predicted in Exodus 23,30 that the land would be conquered in stages, progressively, so that each tribe would have to conquer the area it laid claim to, a person who had sold his share or potential share could not claim exemption form the war of conquest seeing that the land he had sold would be restored to him in the Jubilee year. In any event it would remain part of his tribe’s ancestral heritage. However, the share given to the daughters of Tzelofchod which would not be restored to their tribe in the Jubilee year, would furnish an excuse to members of their tribe not to bother to fight for that piece of land, and they would allow the present owners to remain there. At any rate, the argument of the family of Machir of Menashe was that the most recent legislation could result in the whole principle of sharing out the land by lottery being partially aborted.
