Genèse 43:9

Bible du Rabbinat 1899 [fr]

43

Cependant, la famine pesait sur le pays.
9 אָֽנֹכִי֙ אֶֽעֶרְבֶ֔נּוּ מִיָּדִ֖י תְּבַקְשֶׁ֑נּוּ אִם־לֹ֨א הֲבִיאֹתִ֤יו אֵלֶ֙יךָ֙ וְהִצַּגְתִּ֣יו לְפָנֶ֔יךָ וְחָטָ֥אתִֽי לְךָ֖ כׇּל־הַיָּמִֽים׃ C’est moi qui réponds de lui, c’est à moi que tu le redemanderas: si je ne te le ramène et ne le remets en ta présence, je me déclare coupable à jamais envers toi.

18 וַיִּֽירְא֣וּ הָֽאֲנָשִׁ֗ים כִּ֣י הֽוּבְאוּ֮ בֵּ֣ית יוֹסֵף֒ וַיֹּאמְר֗וּ עַל־דְּבַ֤ר הַכֶּ֙סֶף֙ הַשָּׁ֤ב בְּאַמְתְּחֹתֵ֙ינוּ֙ בַּתְּחִלָּ֔ה אֲנַ֖חְנוּ מֽוּבָאִ֑ים לְהִתְגֹּלֵ֤ל עָלֵ֙ינוּ֙ וּלְהִתְנַפֵּ֣ל עָלֵ֔ינוּ וְלָקַ֧חַת אֹתָ֛נוּ לַעֲבָדִ֖ים וְאֶת־חֲמֹרֵֽינוּ׃ Mais ces hommes s’alarmèrent en se voyant introduits dans la maison de Joseph et ils dirent: "C’est à cause de l’argent remis la première fois dans nos sacs, qu’on nous a conduits ici, pour nous accabler et se jeter sur nous, pour nous rendre esclaves, pour s’emparer de nos ânes."
20 וַיֹּאמְר֖וּ בִּ֣י אֲדֹנִ֑י יָרֹ֥ד יָרַ֛דְנוּ בַּתְּחִלָּ֖ה לִשְׁבׇּר־אֹֽכֶל׃ disant: "De grâce, seigneur! Nous étions venus une première fois pour acheter des provisions;

Ils apprêtèrent le présent, Joseph devant venir à midi; car ils avaient appris que c’était là qu’on ferait le repas.

I will be surety for him: of my hand shalt thou require him. If I bring him not to thee again, and set him before thee, the guilt be upon me before thee all days.

Radak (David Kimhi)

English

Yehudah did not really man that if he did not bring Binyamin back this would automatically be a sin in the objective meaning of the word. He meant that he would consider himself as a sinner against his father forever in the unlikely event that this would happen. He would guarantee his brother’s return under such conditions. These considerations prompted our sages in Makkot 11 to characterise Yehudah as placing himself in the position of a conditional outcast, מנודה, they derive the halachah that someone who places himself in such a state requires the court to annul his conditional vow, status. Needless to say that ostracising oneself from the Jewish community even conditionally is forbidden, and we have a tradition that the bones inside Yehudah’s coffin were rattling for the entire 40 years the Jewish people carried the coffins of the 12 founding leaders of the tribes with them through the desert. This stopped only at the request of Moses who asked mercy for Yehudah in his final blessing in Deuteronomy 33,7,
